Delivery Terms and Conditions

1. Agreement Requirement

These terms and conditions will be made available upon request at the time of delivery and are also available on the Daisy’s Garden Supplies website. Customers are required to read, fully understand, and sign the delivery terms and conditions before our driver will unload/tip your product.

2. Delivery Process and Inspection

  • Client is responsible for checking delivery at the time of drop-off. Any discrepancy in the quantity supplied must be reported immediately at the time of delivery.
  • Once products are left curb side, the customer assumes responsibility for any loss or damage.

3. Liability Waiver/Delivery Risks

Daisy's Garden Supplies is not responsible for property damage during delivery, including driveways, lawns, structures, and landscaping. Customers acknowledge inherent risks associated with delivery, including potential damage to property, landscaping, and utility lines. Risks include:

  • Damage to lawns or grassy areas
  • Harm to walkways, buildings, and surrounding infrastructure
  • Damage to plants, flowers, or other landscaping features
  • Cracks or harm to driveways
  • Impact or damage to utility lines
  • Staining or discoloration of surfaces like driveways or walkways due to leaking fluids or residue from the delivery vehicle or the dispensed materials
  • Structural or landscape damage caused by the weight, size, or width of the delivery vehicle, affecting driveways, landscaping, fences, pavers, or other features
  • Inconvenience or damage resulting from delivering goods to a location other than the one specified by the customer


4. Delivery Timeframe

  • Daisy’s Garden Supplies will provide an estimated time of delivery, which is subject to change and will then be dependent on factors outside of our control, such as traffic. We are not responsible for costs associated with late deliveries where factors are outside of our control.

5. Age Requirement

Signers must be at least 18 years old and legally competent to sign the agreement.

6. Access Requirements

We must have clear access to the delivery site (especially for hand unloads). This includes clear pathways, gate access, no obstructions, etc. Any access limitations (steps, hills, overhanging trees) must be clearly communicated and approved prior to delivery. The customer is responsible for ensuring this before our arrival. If there are access restrictions, we reserve the right to refuse delivery or request your assistance where possible/appropriate.

7. Wait Time

If you are not available to unload immediately at the time of delivery, you must communicate this to us. We will wait for 20 minutes; after that, we reserve the right to charge a detention fee.

8. Bogging Responsibility

The driver can choose not to follow directions based on their discretion and professional knowledge of the truck's capabilities. If a delivery vehicle becomes bogged due to customer directions, the customer will cover all associated costs, including towing fees.

9. Wrong Address/Information

If the incorrect address is supplied, a new delivery fee can be charged to the customer.

10. Return/Restocking Fee

A fee will apply for deliveries that cannot be completed due to site restrictions or unsafe conditions.

11. Cancellation Policy

Orders may only be cancelled if goods have not already been dispatched. If goods have been dispatched but not yet delivered (in the case of truck deliveries), a refund less the cost of the delivery fee will be considered. Refunds are processed via the same method as the original payment (i.e. payments made by credit card will be refunded via credit card). Refunds do not apply to garden supplies products sold by the meter (i.e. mulch, soils, pebbles, etc.) and delivered. No refunds will be given without a receipt.
